Abstract: The basic criminal policy of leniency and severity must be upheld to meet the development of China's current times and society. The legislation, judiciary and law enforcement of criminal law in protecting citizens' personal information are examined, and the criminal policy of "leniency and severity" is applied to propose that the protection of citizens' personal information in criminal law should be tightened in legislation, balanced in judiciary, and coordinated and joint in law enforcement under the guidance of the criminal policy of "leniency and severity" so that the crime of personal information of citizens can be prevented and controlled, which is of great practical significance to the overall construction of personal information of citizens in China.
