Construction of a Networked Data Rights Mechanism Based on Layered Personal Data in a Scenarized Perspective

Abstract: Personal data is the cornerstone of data classification and rights confirmation. Layered rights confirmation matters because it seeks to balance data circulation and privacy protection—a concern that directly involves digital dignity, informational self-determination, and a sustainable digital ecosystem. Traditional mechanisms, with their absolutized ownership or rigid authorization, cannot adapt to the dynamic rights relationships in cross-scenario data flows, often leaving data monopoly and privacy leakage entrenched together. To address this, we propose a criss-cross, grid-like mechanism structured around three dimensions: scenario types (purely personal data, personal data fused with enterprise data, and personal data interacting with public data), data forms (raw data, derivative data, data products), and a rights bundle (the right to hold data resources, the right to process and use data, and the right to operate data products). Integrating these dimensions yields an architecture that is horizontally adaptive to scenarios and vertically layered—namely, horizontal scenario adaptation with vertical layered rights confirmation.
