Abstract: As a fundamental institution, the land system has always been a concentrated reflection of a country’s basic economic and political systems in terms of the means of production. The policies of the Communist Party of China (CPC) regarding the land system have continuously evolved in response to social development and changes in the principal contradictions, establishing a land system that aligns with economic and social progress and has driven economic and social development. Land system reform cannot proceed without sound legal and policy support. This paper analyzes the legal framework of China’s rural land contract management rights from both legislative and judicial perspectives, aiming to provide insights and models for addressing land-related legal issues in the process of rural revitalization.

Key words: rural land contract management rights, process of legalization, separation of two rights, tripartite separation of rights
