Legal Regulation of Middle School Students' School Bullying Cases

Abstract: In Middle School, the school bullying of a younger age tends to become more evident. Because of the Principle of Best Interests of Children, China has long adopted the approach of education correction to discipline the bullies. However, this approach leads to the result that the legal responsibilities of the bullies don't correspond with the consequence of the school bullying. There is a serious disconnecting between the governance model of school bully and the actual demands. In order to effectively curb the cases of school bullying and better protect the rights and interests of the minors, the criminal polily of minors should be correctly understood and applied, and the administrative detention age should be lowered, as well as the responsibility of the educators and guardians should be strictly cleared.
