Abstract: The aggrieved party’s statement and the witness’s statement are independent of each other as evidences in the criminal proceedings, but in the judiciary practice, the aggrieved party’s duality, unidirectionality of the statement, appearance in court, provision of the evidence, question of the evidence and the burden of the aggrieved party’s false evidence cause many problems. The status of the aggrieved party in the criminal proceedings is not improved and his rights are not protected by categorizing the aggrieved party into the client under the background of lack of state compensation rules and inadequate social aiding system. Therefore, the essential method for the problems is to put the aggrieved party’s statement as the witness’s evidence and develop comprehensive protecting system for the aggrieved party.
