Abstract: Children's rights are an independent right enjoyed by children as an independent subject, and a comprehensive right produced by the universality of human rights and the particularity of children. At present, China has basically established a basic legal framework for the protection of children's rights, focusing on the recognition and protection of children's rights in judicial protection and the right to education. But child welfare legislation has lagged behind social reality. The problem of rural children's rights protection is prominent. The state should seize the historical opportunity of the implementation of the “rural strategy”, perfect the legislation of children's welfare, and perfect the legal system of child rights protection.
