商鞅政治思想的逻辑及其二重性特征

摘要/Abstract

摘要： 自然人性论是商鞅政治思想的基础。所谓性之自然,在人身上主要表现为天性自私自利。基于此现实,商鞅一方面极度不信任儒家所谓的道德自觉,另一方面深感法治的必要性。与此相应,商鞅的政治思想在其逻辑上就体现为从人性恶到道德无用,并不断趋近于具有现代民主政治意味的法治理念。与此同时,商鞅政治思想呈现出二重性特征,即存在着国家本位的合乎理性的价值取向,然而却逃不出封建专制制度君主本位的现实困境。即便如此,商鞅政治思想的合理性因素对现代中国法治建设仍具有一定的启示意义。

Abstract: Natural Humanity Theory is the foundation of Shang Yang’s Political Thoughts. With regard to human, the nature refers to the reality of human being’s selfishness. Shang Yang held that Confucianism was useless, not enough to govern the country and argued for the necessity to rule by law. His thoughts developed from evil human nature, useless humanity to modernized governance by law. The political thoughts of Shang Yang had the rational nation-oriented value but could not escape the plight of the monarchy-centered value popular in the ancient Chinese feudal autocratic system. Even so, Shang Yang’s political thoughts would bring some inspiration and enlightenment to China’s legal system construction today.
